Driver Terms and Conditions

Introduction

This Driver Partner Agreement ("Agreement") is entered into between MaryGo Riders Limited ("MaryGo Riders," "Company," "we," "our," or "us") and the individual or entity registered as a driver on the MaryGo Riders platform ("Driver," "you," or "your").

By registering as a driver or accepting ride requests through the MaryGo Riders platform, you agree to these Terms and Conditions.

1. Independent Contractor Relationship

The Driver is an independent contractor and not an employee, agent, partner, or joint venturer of MaryGo Riders.

Nothing in this Agreement shall be interpreted as creating an employer-employee relationship.

The Driver is solely responsible for:

• Choosing when to log into the platform
• Accepting or declining ride requests
• Paying personal income taxes
• Pension obligations
• Insurance obligations
• Regulatory compliance

2. Driver Eligibility

Drivers must:

• Be at least 21 years old
• Possess a valid Nigerian Driver's Licence
• Have a valid National Identification Number (NIN) or other government-approved identification
• Pass identity verification
• Successfully complete background screening where required
• Meet all vehicle inspection requirements
• Maintain a valid mobile phone capable of running the MaryGo Riders App

MaryGo Riders reserves the right to reject any application.

3. Vehicle Requirements

Every vehicle must:

• Be legally registered in Nigeria
• Have current vehicle insurance
• Be roadworthy
• Pass inspection by MaryGo Riders or an approved inspection center
• Have working seat belts
• Have functioning headlights, brake lights, indicators, horn, and windshield wipers
• Maintain clean interiors and exteriors
• Be free from major body damage

Vehicles failing inspection may be removed from the platform until deficiencies are corrected.

4. Driver Conduct

Drivers shall:

• Treat all riders courteously and professionally
• Drive safely at all times
• Obey all traffic laws
• Wear appropriate clothing
• Keep vehicles clean
• Assist passengers where reasonable
• Maintain a respectful attitude toward all users regardless of race, religion, gender, disability, nationality, or age

Drivers shall not:

• Consume alcohol or illegal drugs before or during driving
• Smoke inside the vehicle while transporting riders
• Carry weapons except where legally authorized
• Harass or discriminate against riders
• Request payments outside the App unless authorized
• Solicit personal relationships with riders using information obtained through the platform

5. Acceptance of Trips

Drivers are free to accept or decline ride requests.

However, repeated cancellations after accepting rides or repeated no-shows may result in:

• Temporary suspension
• Reduced trip priority
• Permanent removal from the platform

6. Driver Ratings

Drivers are expected to maintain a satisfactory customer rating.

MaryGo Riders may review:

• Low ratings
• Rider complaints
• Safety complaints
• Service quality
• Professional conduct

Repeated poor performance may result in coaching, suspension, or account deactivation.

7. Fares and Earnings

Drivers earn income from completed trips, less any agreed service fee or commission payable to MaryGo Riders.

Driver earnings may include:

• Base fare
• Distance charges
• Time charges
• Surge pricing where applicable
• Tips paid voluntarily by riders
• Incentive bonuses offered by MaryGo Riders

MaryGo Riders may revise fare structures and commission rates upon reasonable notice through the App or other communication channels.

8. Payments

Driver earnings will be paid according to the payout schedule communicated by MaryGo Riders.

Payments may be made by:

• Bank transfer
• Mobile wallet
• Other approved payment methods

Drivers are responsible for ensuring their banking details remain accurate.

9. Driver Commission

MaryGo Riders shall deduct its applicable service commission before paying driver earnings.

Applicable taxes and government charges may also be deducted where required by law.

10. Taxes

Drivers acknowledge they are independent contractors and are solely responsible for:

• Personal income tax
• VAT where applicable
• Business registration obligations
• Pension contributions
• Other statutory obligations imposed by law

MaryGo Riders does not provide tax advice.

11. Insurance

Drivers must maintain all legally required insurance coverage throughout their participation on the platform.

Failure to maintain required insurance may result in immediate suspension or deactivation.

12. Safety Requirements

Drivers must:

• Never drive while fatigued or impaired
• Wear seat belts
• Ensure passengers wear seat belts where available
• Observe speed limits
• Avoid distracted driving
• Report accidents immediately
• Cooperate with emergency services

Safety violations may result in immediate suspension pending investigation.

13. Accidents

Drivers must notify MaryGo Riders immediately after:

• Road traffic accidents
• Injuries
• Property damage
• Criminal incidents
• Assaults
• Vehicle theft

Drivers remain responsible for complying with all reporting obligations under Nigerian law.

14. Zero-Tolerance Policy

MaryGo Riders has zero tolerance for:

• Driving under the influence of alcohol
• Drug impairment
• Sexual harassment
• Physical assault
• Threats
• Criminal conduct
• Human trafficking
• Fraud
• Identity theft

Violations may result in permanent removal from the platform and referral to law enforcement authorities.

15. Fraud Prevention

Drivers shall not:

• Create fake trips
• Manipulate GPS
• Use unauthorized software
• Share driver accounts
• Permit unauthorized individuals to drive using their account
• Collect unauthorized fees
• Circumvent payment systems

Confirmed fraud may result in immediate termination and legal action.

16. Confidentiality

Drivers shall keep confidential any personal information obtained through the platform, including:

• Rider names
• Telephone numbers
• Pickup addresses
• Destination addresses
• Payment information
• Personal conversations

Personal information may only be used for completing the requested trip.

17. Privacy

Drivers shall comply with the Nigeria Data Protection Act 2023 and MaryGo Riders' Privacy Policy.

Drivers shall not record, publish, disclose, or share rider information except where required by law.

18. Intellectual Property

The MaryGo Riders name, logo, software, trademarks, and mobile application remain the exclusive property of MaryGo Riders.

Drivers receive only a limited, non-transferable license to use the App for providing transportation services through the platform.

19. Suspension and Deactivation

MaryGo Riders may suspend or permanently deactivate a driver's account for reasons including:

• Fraud
• Criminal conduct
• Unsafe driving
• Failure to maintain required documentation
• Repeated customer complaints
• Violence or harassment
• Discrimination
• Impersonation
• Vehicle safety concerns
• Violation of this Agreement

Where appropriate, drivers may be given an opportunity to respond before a final decision is made.

20. Limitation of Liability

To the fullest extent permitted by law, MaryGo Riders shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from a driver's participation on the platform.

Nothing in this Agreement excludes liability that cannot lawfully be excluded under Nigerian law.

21. Indemnification

The Driver agrees to indemnify and hold harmless MaryGo Riders, its directors, officers, employees, agents, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising out of:

• The Driver's negligence or misconduct;
• Breach of this Agreement;
• Violation of applicable law; or
• Damage or injury caused during the provision of transportation services.

22. Dispute Resolution

The parties shall first attempt to resolve disputes through good-faith discussions.

If unresolved, the parties may submit the dispute to mediation before commencing court proceedings.

This Agreement shall be governed by the laws of the Federal Republic of Nigeria, and disputes shall be subject to the jurisdiction of courts of competent jurisdiction in Nigeria.

23. Amendments

MaryGo Riders may amend this Agreement from time to time. Updated versions will be published through the App or other official communication channels.

Continued use of the platform after the effective date of an amendment constitutes acceptance of the revised Agreement.

Driver Acknowledgment

By registering as a Driver Partner and using the MaryGo Riders platform, I acknowledge that I have read, understood, and agree to be bound by this Driver Partner Agreement, Driver Terms, Policies, and Conditions. I confirm that I will comply with all applicable laws, maintain all required licenses and insurance, operate my vehicle safely, protect rider privacy, and adhere to the standards and policies established by MaryGo.
